Introduction

These terms govern your use of the Kytran Empowerment website, the A.R.C.H.I.E. platform and our related products (together, the “Services”), provided by Kytran Empowerment Inc. (“Kytran Empowerment”, “we”, “us”) of Montreal, Quebec, Canada. By using the Services you agree to these terms and to our Privacy Policy.

1. The Services

The Services are described on our website and may change over time. Some features may be offered as previews or beta releases and may be modified or withdrawn.

2. Accounts

You are responsible for your account credentials and for activity under your account. Give us accurate information and tell us promptly about any unauthorised use.

3. Connecting third-party accounts

If you connect a third-party account, such as a Google Account, you authorise us to access it only as described in the Privacy Policy and only to provide the features you use. You confirm you have the right to grant that access, and you can revoke it at any time in the provider’s settings or in the platform.

4. Acceptable use

You agree not to:

  • break the law or infringe anyone’s rights;
  • attempt to gain unauthorised access to the Services, other accounts or our systems;
  • interfere with or overload the Services, or probe them for vulnerabilities without our written permission;
  • use the Services to send spam or to distribute malware or unlawful content.

5. AI-generated content

The Services use AI to generate content and take actions. AI output can be wrong or incomplete. You are responsible for reviewing it before relying on it, and it is not professional, legal, financial or medical advice.

6. Fees

Paid plans are billed monthly, and enterprise plans are billed annually under custom terms. You can cancel at any time. Upgrades are prorated, and downgrades take effect at the start of your next billing cycle. We offer a 14-day money-back guarantee on paid plans: contact us within 14 days for a full refund. 7. Your content

You keep ownership of the content you provide. You give us a limited licence to host, process and back it up as needed to run the Services for you.

8. Our intellectual property

The Services, including the software, designs and trademarks, belong to Kytran Empowerment or its licensors. These terms do not transfer any of that ownership to you.

9. Third-party services

Some features rely on third-party services. Their terms apply to your use of them, and we are not responsible for them.

10. Disclaimers

The Services are provided “as is” and “as available”. To the extent the law allows, we disclaim all warranties, including fitness for a particular purpose, and we do not promise uninterrupted or error-free operation.

11. Limitation of liability

To the extent the law allows, Kytran Empowerment is not liable for indirect, incidental or consequential damages, or for loss of data, profits or business, arising from your use of the Services. Nothing in these terms limits any right or remedy that cannot be limited under applicable law, including consumer protection law.

12. Suspension and termination

You may stop using the Services at any time. We may suspend or end access if you breach these terms or put the Services or others at risk. Sections that by their nature should survive will survive.

13. General

  • Severability: if a part of these terms is found unenforceable, the rest stays in effect.
  • Entire agreement: these terms and the Privacy Policy are our whole agreement about the Services.
  • Assignment: you may not transfer your rights under these terms without our consent. We may transfer ours in connection with a business transfer.
  • Notices: we may notify you in the Services or by email, and you can write to us at the address in section 16.

14. Governing law

These terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable there. Disputes will be brought before the courts of the judicial district of Montréal, subject to any mandatory consumer rights to a different forum.

15. Changes

We may update these terms. We will change the date at the top and, for material changes, notify you. Continued use after a change means you accept it.
